Terms of Service
1. Service Overview
Gabriel Care is a health sharing community, not health insurance. Members voluntarily pool resources to share medical expenses through a community-based model. Gabriel Care is organized as a for-profit health sharing ministry under ACA Section 1501.
We provide a technology platform, Gabriel Intelligence (our AI health assistant), and administrative services to facilitate health sharing among members. Gabriel Labs LLC operates Gabriel Care and provides all associated services.
2. Eligibility
To use Sanctum, you must:
- Be at least 18 years old
- Be a legal resident of the United States
- Provide accurate and complete registration information
- Maintain the accuracy of your account information
3. Account Registration
When you create a Gabriel Care account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Membership & Payments
Monthly Subscription: Membership to Gabriel Care requires a monthly subscription payment processed via Stripe. Current membership tiers are:
- Care: $199/month
- Gabriel Care Plus: $299/month
Auto-Renewal: Your membership will automatically renew each month on your billing date unless you cancel. By subscribing, you authorize us to charge your payment method on a recurring basis.
Cancellation: You may cancel your membership at any time by providing 30 days advance notice through your account settings or by contacting support@askgabriel.com. Cancellation will be effective at the end of your current billing period. No refunds will be issued for partial months.
Price Changes: We reserve the right to change membership fees with 30 days advance notice.
5. Wellness Benefit
Your membership includes a monthly wellness benefit funded through the pooled contributions of all members:
- Care: $620/month pooled wellness benefit
- Gabriel Care Plus: $1,200/month pooled wellness benefit
Important Limitations:
- The wellness benefit is not insurance and does not guarantee payment
- Benefit amounts are pooled community resources, not individual accounts
- Benefits do not roll over month to month
- Sharing of medical expenses is voluntary and at the discretion of Gabriel Labs
- Payment depends on available community funds and compliance with these Terms
6. Claims Submission & Processing
Submission Process: You may submit eligible medical expenses by uploading receipts through the Gabriel chat interface or mobile app. All claims must include:
- Itemized receipt or invoice
- Provider name and contact information
- Date of service
- Description of services rendered
AI Verification: Claims are verified using Gabriel Intelligence, which checks:
- Eligibility of service under your membership tier
- Fair market pricing for the service and geographic area
- Available wellness benefit balance
- Compliance with waiting periods and guidelines
Fair Market Pricing: Gabriel Labs reserves the right to adjust reimbursement amounts to fair market pricing if submitted claims exceed typical costs for the service in your area. Fair market pricing determinations are final.
Payment Timeline: Approved claims are typically reimbursed within 24-48 hours to your linked bank account via Stripe Connect.
Right to Deny: Gabriel Labs reserves the right to deny, reduce, or delay any claim that does not meet eligibility requirements, exceeds fair market pricing, or violates these Terms.
7. Prohibited Uses
You agree not to:
- Submit false, fraudulent, or misleading claims
- Misrepresent the nature, cost, or date of services
- Submit claims for services not actually received
- Share your account credentials with others
- Use the service for any unlawful purpose
- Attempt to circumvent AI verification systems
- Abuse, harass, or harm other members or our staff
- Reverse engineer or attempt to access our systems without authorization
8. Intellectual Property
You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.
9. Privacy
Your use of Gabriel Care is also governed by our Privacy Policy, which can be found at askgabriel.com/privacy. By using our services, you consent to the collection and use of information as described in the Privacy Policy.
10. Disclaimers
NOT INSURANCE: Gabriel Care is not health insurance. It is a health sharing community. There is no guarantee that your medical expenses will be shared or reimbursed.
NOT MEDICAL ADVICE: Gabriel Intelligence and all content provided through Gabriel Care are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions.
NO GUARANTEE OF PAYMENT: While we strive to process eligible claims promptly, Gabriel Labs does not guarantee payment of any claim. Payment is subject to available community funds, verification, and compliance with these Terms.
AS-IS SERVICE: Gabriel Care is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Gabriel Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use Sanctum
- Any unauthorized access to your account or data
- Any denial or delay in claim payment
- Any errors or omissions in our service
- Any conduct or content of third-party providers
Maximum Liability: In no event shall Gabriel Labs LLC's total liability to you for all damages exceed the total amount of membership fees you paid to us in the twelve (12) months preceding the claim.
12. Dispute Resolution & Arbitration
Informal Resolution: If you have a dispute with Gabriel Labs, please first contact us at support@askgabriel.com to attempt to resolve the matter informally.
Binding Arbitration: If we cannot resolve a dispute informally, you and Gabriel Labs agree that any dispute, claim, or controversy arising out of or relating to these Terms or Gabriel Care shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
Class Action Waiver: You and Gabriel Labs agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative action.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
13. Modifications to Terms
Gabriel Labs reserves the right to modify these Terms at any time. We will provide you with 30 days advance notice of any material changes via email or through the Gabriel Care app.
Your continued use of Gabriel Care after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must cancel your membership.
14. Termination
Your Right to Terminate: You may terminate your membership at any time with 30 days notice as described in Section 4.
Our Right to Terminate: Gabriel Labs may suspend or terminate your account immediately if you:
- Violate these Terms
- Submit fraudulent claims
- Fail to pay membership fees
- Engage in prohibited conduct
Effect of Termination: Upon termination, your access to Gabriel Care will cease, and you will no longer be eligible to submit claims. Pending claims submitted prior to termination will be processed according to these Terms. No refunds will be issued upon termination.
